Robin Geddes, Regulatory Policy Manager at the Legal Services Board (LSB), attended the Professional Associations Research Network (PARN) forum on Continuing Professional Development (CPD) on 20 June 2022. He discussed the LSB’s latest work developing proposals for the regulators on ensuring the ongoing competence of regulated legal professionals.
At present, CPD is one of the main tools used by the legal regulators to provide assurance of ongoing competence. The LSB thinks that this approach has its limitations and regulators should consider putting in place other measures to provide better assurance.
In 2021, the LSB published a research report that looked into assurance of ongoing competence in other jurisdictions and found wide use of CPD abroad too, but also similar challenges in its application. The presentation prompted a discussion with attendees about other measures in other sectors, including use of reflective practice.
